The Supreme Court of South Korea has made its final decision on Jung Joon Young and Choi Jong Hoon's appeals. Last November, the Seoul Central District Court sentenced Jung Joon Young to six years in prison and Choi Jong Hoon to five years in prison for charges including aggravated rape (i.e., rape that involves two or more perpetrators). Both the defendants and the prosecution appealed the ruling, leading to a new round of hearings this year. In May, the Seoul High Court reduced Jung Joon Young's prison sentence to five years, while Choi Jong Hoon's prison sentence was reduced to two years and six months. Both defendants went on to appeal the new ruling as well, which brought the case to the Supreme Court. It has now been reported that on September 12, the Supreme Court chose to dismiss both appeals and uphold the original prison sentences. Explaining the decision to uphold the previous ruling, the court stated, There was no violation of legal principles or misrepresentation of facts due to subjective reasoning or experience in the original ruling, and there was also no misconception of jurisprudence. On July 19 during the appeal trial at the Seoul High Court (with presiding judge Jo Yong Hyun), Jung Suk Won asked for leniency by stating, I will live devoted to my family while reflecting [on my actions] and helping many people. Back in February 2018, Jung Suk Won was arrested under suspicions of using drugs such as a Philopon (a form of methamphetamine) and cocaine at a bathroom in a club in Melbourne, Australia with his high school friends. He was arrested at the airport upon arriving in Korea where he admitted to the charges, took drug tests, and was held in detention during the investigation. On October 11, 2018, Jung Suk Won was sentenced to 10 months in prison, suspended for two years, during his first trial on account that he didn't have any other criminal record of drugs and was reflecting on his actions. Jung Suk Won's sentence at the time meant that he would be on probation for two years and serve 10 months in prison if he violated the condition of the suspension during those two years. He was also ordered to pay an additional 300,000 won (approximately $256). However, the prosecution appealed the court's partial verdict.
